Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Earthwise mobile application, website, and any related services (collectively, the “App”). By downloading, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must immediately cease use of the App.
1. Scope and Nature of the Service
Earthwise is a global data visualisation and aggregation platform that presents environmental and natural hazard-related information, including but not limited to earthquakes, seismic activity, tsunamis, volcanic activity, flood modelling, river discharge data, and related geophysical indicators.
The App is provided strictly for general informational, educational, and observational purposes only. It is not designed, intended, or suitable for real-time emergency response, hazard mitigation, life safety decision-making, or operational planning.
Earthwise does not provide:
- Emergency alerts or warning systems
- Predictive modelling intended for decision-making
- Safety instructions, recommendations, or guidance
- Professional, governmental, or expert advice
2. No Reliance / User Assumption of Risk
You expressly acknowledge and agree that:
- The App must not be relied upon for any safety-critical, time-sensitive, or life-dependent decisions
- All information is used entirely at your own risk
- You are solely responsible for verifying any information through official, authoritative sources
Use of the App in situations involving personal safety, evacuation, travel decisions, infrastructure planning, or emergency response is strictly at your own risk.
3. Data Limitations and Accuracy Disclaimer
The App aggregates and displays data from multiple external sources. Due to the nature of global environmental data systems, you acknowledge that:
- Data may be delayed, incomplete, inaccurate, or outdated
- Geographic coverage may vary significantly by region
- Measurement methodologies may differ between sources
- Data may be subject to outages, errors, or transmission delays
- Forecasts, models, or projections (including flood modelling) are inherently uncertain
Earthwise makes no representations, warranties, or guarantees regarding:
- Accuracy
- Completeness
- Timeliness
- Reliability
- Suitability for any purpose
4. No Liability (Maximum Extent Permitted by Law)
To the fullest extent permitted by applicable law, Earthwise, its developers, operators, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with:
- Use or inability to use the App
- Reliance on any information or data provided
- Errors, omissions, or inaccuracies in data
- Delays or interruptions in service
- Decisions made based on App content
This exclusion includes, without limitation:
- Personal injury or death
- Property damage
- Financial or economic loss
- Loss of opportunity
- Business interruption
If liability cannot be excluded under applicable law, it shall be limited to the minimum extent permitted.
5. Not an Emergency or Safety System
Earthwise is not an emergency notification system and is not integrated with official warning systems.
You must always rely on:
- Government agencies
- Emergency services
- Official alert systems
- Local authorities
for all safety-related decisions, warnings, and instructions.
6. Global Use and Jurisdictional Variability
The App is made available globally and may be accessed in multiple jurisdictions with differing laws, regulations, and standards.
You acknowledge that:
- The App may not comply with specific local regulatory requirements
- Data availability and accuracy may vary by region
- Certain features may not be suitable or lawful in all jurisdictions
You are solely responsible for ensuring that your use of the App complies with applicable local laws.
7. Third-Party Data and Services
Earthwise relies on third-party data providers and external systems.
We do not:
- Control third-party data sources
- Guarantee their accuracy or availability
- Accept responsibility for their content
Any reliance on third-party data is entirely at your own risk.
8. Service Availability and Changes
We reserve the right, at any time and without notice, to:
- Modify, suspend, or discontinue the App or any features
- Change or remove data sources
- Update or alter functionality
We do not guarantee uninterrupted or error-free access.
9. No Warranties
The App is provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to:
- Fitness for a particular purpose
- Accuracy or reliability
- Non-infringement
- Availability or performance
10. Limitation of Use
You agree not to:
- Use the App in any safety-critical or high-risk environment
- Reverse engineer, interfere with, or disrupt the App
- Use the App in any unlawful or harmful manner
11. Indemnification
You agree to indemnify and hold harmless Earthwise, its developers, and affiliates from any claims, damages, liabilities, losses, or expenses arising from:
- Your use of the App
- Your reliance on App data
- Your violation of these Terms

We may update these Terms at any time without prior notice. Continued use of the App constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree that any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by applicable law.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms constitute the entire agreement between you and Earthwise regarding use of the App and supersede any prior agreements or understandings.
